Terms and Conditions for TechSoup's Earth Day Webinar Giveaway Contest as of April 23, 2024.

 

  1. Eligibility: The giveaway contest is open to participants who meet the following criteria:

    • Reside in the Contiguous United States.
    • Are 18 years of age or older.
    • Are employees (part-time or full-time) of 501(c)(3) nonprofit organizations, registered with TechSoup prior to April 23, 2024.

  2. Entry: No purchase or payment is required to enter the contest. Participants must register and attend this webinar: https://events.techsoup.org/events/details/techsoup-techsoup-events-and-webinars-presents-why-refurbished-hardware-is-the-best-choice-for-sustainability-and-savings/. Participant must be present for the duration of the webinar to win.

  3. Duration: The giveaway contest starts on April 23, 2024 10:00 a.m. PST and ends on April 23, 2024 11:00 a.m. PST. Must be present to win.

  4. Prize: The winner will receive a refurbished 2020 MacBook Air laptop, backed by a one-year warranty, such warranty to be provided by Injured Gadgets, not by TechSoup. Any concerns regarding the product and the warranty shall be directed to Injured Gadgets. The prize, as defined in the terms, is non-transferable, and there will be no cash alternatives to it. TechSoup reserves the right to substitute the prize with a product or service of equal value.

  5. Winner Selection: The winner will be selected randomly from all eligible entries at the end of the webinar.

  6. Publicity: By participating in the giveaway contest, the winner agrees to allow TechSoup to use the winner’s name, photograph, and likeness for promotional and advertising purposes without compensation. 

  7. Liability: TechSoup is not responsible for any injury, loss, or damage to participants, or their property related to their participation in the giveaway contest. Participants agree to release and hold harmless TechSoup and its affiliates from any liability, injury, loss, or damage resulting from participation in the giveaway contest or acceptance, use, or misuse of the prize.

  8. Governing Law and Dispute Resolution:  These Terms and Conditions will be governed by the laws of the State of California without regard to its conflict of laws principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply to these Terms and Conditions. All disputes, controversies or claims between the parties arising from or in relation to these Terms and Conditions, including the formation, interpretation, breach, or termination thereof, including whether the claims asserted are arbitrable, will be referred to arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association (“AAA”) before a single arbitrator jointly selected by the parties or, if the parties are unable to agree, by AAA. The arbitration hearings will be conducted in the English language and will take place in San Francisco, California. The decision of the arbitrator will be final, binding and conclusive upon the parties. Each party will bear its own costs incurred in such arbitration proceeding.

  9. Modification: TechSoup reserves the right to modify, suspend, or terminate the giveaway contest without notice. TechSoup also reserves the right to modify these Terms and Conditions without notice.
